As a passenger, you are just as exposed to the risk of a car crash as anyone else. But it can be difficult to know how to take care of your expenses. Understanding who is liable and understand your rights when you’re in this situation will go a long way towards making sure you receive the care you deserve.

Passenger Insurance Claims

Passengers injured in an accident involving your vehicle can file compensation claims to pay their medical bills, settle damages, discomfort, pain, and recoup lost earnings — and they should. But in a typical two-car accident, the best practice for an injured passenger is to file a claim against both drivers. A passenger is almost never going to be found liable in any way, where at least one of the drivers will almost certainly be found to have at least some percentage of fault for the accident. This is the basic “third party” accident claim.

Dog Bites and Post-Traumatic Stress

PTSDPost-traumatic stress disorder is a prevalent, yet often misunderstood, psychological issue in society today. Post-traumatic stress disorder (PTSD) can come from many different distressing events, including, for example, a dog bite. Dog bites can happen to anyone of any age, and dog bite victims often suffer long after the actual bite occurs. Dog bites are not only physically painful; they can cause PTSD as well. In this article, we will discuss the connection between PTSD and dog bites, as well as your legal rights as a victim.

What is PTSD?

PTSD manifests itself in a number of different ways, but, broadly, the disorder is characterized through three major symptoms: (1) flashbacks, memories, and nightmares that cause the person to re-experience the trauma they suffered, (2) emotional desensitization (often described as a sense of “numbness”) and avoidance of things that may trigger memories of the trauma, and (3) increased hypersensitivity that can cause hypervigilance, problems sleeping and concentrating, and irritability.

The Misclassification of Employees and Workers Compensation

The misclassification of employees by companies is a serious problem, and it often leads to issues regarding workers’ compensation, payroll, and the rights and protections they receive from legislation pertaining to these classifications. Companies most frequently misclassify employees in low-wage-earning jobs, particularly ones with many immigrant workers, by deeming them “independent contractors” instead of full-time employees who are eligible for the protection that labor and wage laws provide.

According to the National Employment Law Project, the typical result of this misclassification is a decrease in the payroll expenses on the part of employers to the tune of 15-30%. Underreported wages have been estimated by the US Government Accountability Office, to total (at least) $436 million. Whether accidental or intentional, the misclassification of vulnerable employees is unjust, and states have recently been passing legislation to stop this harmful practice.

Healthcare-Acquired Infections and Personal Injury Law

Healthcare-acquired infections (HAI) are so common that in 2013, the U.S Department of Health and Human Services made reducing the number of hospital-acquired infections a major goal. These infections have been estimated to be responsible for patients staying an average of 17.6 days more than they ought to, costing patients an extra $1,100 on average in medical costs.

But unfortunately, it doesn’t just stop there. A 2007 National Institute of Health report estimates that there were 1.7 million healthcare-acquired infections in 2002 which were linked to nearly 99,000 deaths in that year. Data released by the Center for Disease Control and Prevention (CDC) showed that about 722,000 people were infected in acute care hospitals in 2011, contributing to about 75,000 deaths in the same year.

Appealing a Decision on Your Health Insurance Claim

When you or a loved one is in the hospital, the last thing you want to think of is how you’re going to pay your medical bills. Having your health insurance claim rejected is almost the ultimate insult to injury. The good news is that no matter the reason, your insurance provider is required to inform you of their denial, and you have the right to appeal it within six months of the notice they provide.

Ascertain the Cause of Denial

The first thing you need to do is look at the EOB (explanation of benefits) from your insurance company explaining the reason for the denial of coverage.

The exact reason for the denial may be found in the form of codes that may require you to reference a key, usually provided on the same document. If, after going through the forms you’re still unable to figure out what the exact issue was, speak to an agent. They are obligated to tell you why your application was denied.
