Top Theme Park Accidents of 2015

January 1, 2016 by David R. Heil, PA

When visiting a theme park, you expect your family to be safe. After all, you are spending hundreds of dollars for a day, week, or more of entertainment. Safety is the least of what you deserve when going on vacation. However, even this basic need is sometimes not met. The year 2015 has shown us that it is not always fun and games, and teaches us what happens when our favorite attractions go awry. The following are our top picks for theme park accidents in 2015.

Slingshot Snaps

At a theme park in France, the cable on a slingshot ride snaps off, sending riders careening into the side of a support column. Though only minor injuries were reported, the incident was caught on camera. A local newspaper reported a factor defect in the elastic band was cause for the malfunction. This accident is eerily similar to another accident that occurred in Wisconsin.

Warning!!! Never Pressure Clean Your Shingle Roof

December 17, 2015 by David R. Heil, PA

Please remember to not ever pressure clean your shingle roof. I am sitting in a deposition where State Farm is alleging that damage to the roof was done by pressure washing the roof, not  storm damage.

Also pressure cleaning a roof even with low pressure may void the shingle warranty. Here is an article of the issue.

Why You Should Never Pressure Wash Your Roof Shingles

You come home one day and your neighbor’s roof looks spectacular and so clean! It can’t be a new roof because roofers haven’t been there. So what is it? The neighbor had their roof pressure washed. Now you’re thinking of having your roof “cleaned” too. After all, his roof looks brand new, and well…yours doesn’t.

Proving Post-Traumatic Stress in Court

November 15, 2015 by David R. Heil, PA

Suffering an injury is a traumatic event regardless of the circumstances. What you once thought was a place of safety has proven to be otherwise. Among the many physical injuries that result from an accident, you may find yourself needing psychiatric care to move forward. Post-traumatic stress disorder is just one of these psychiatric issues, and one that can happen as a result of any form of trauma. Our legal system recognizes that claims for psychiatric injury are just as valid as claims for physical injury. However, because it is harder to see mental harm, different standards of proof apply. This article is meant to go over what it takes to prove that your injury caused post-traumatic stress disorder or any other psychological disorder.

Emotional Distress in Law

October 15, 2015 by David R. Heil, PA

When you are injured in an accident, damage beyond the physical can result. Your emotional well-being can be compromised as a result of an accident. This could cost you important relationships, and even your livelihood. Courts around the country are recognizing that emotional distress is severe enough that it deserves compensation. While Florida law recognizes emotional damages, it follows what is called the impact rule. To help you understand this rule, first we have to go over what emotional distress is and how it impacts your case.

Defining Your Pain and Suffering

September 25, 2015 by David R. Heil, PA

In law shows and news broadcasts, the phrase “pain and suffering” is frequently thrown around. It is often portrayed as an “add-on” to the objectively quantifiable medical bills and lost wages from an accident. However, pain and suffering is a very real factor in personal injury cases. From a legal standpoint, your pain and suffering refer to any distress (physical or mental) that results from an injury. This can range from broken bones to pain, mental disorders resulting from the accident, potential shortening of life, and more.

It is important to remember in a personal injury case that “pain and suffering” is a class of damages on its own, referred to as “general damages.” This is distinct from the “special damages” you are owed including medical bills and lost wages.
